RALEIGH, N.C. (AP) — A North Carolina prosecutor isn’t pursuing criminal contempt charges stemming from a court battle over a video purported to show ex-presidential candidate John Edwards having sex with his then-mistress.

The prosecutor assigned to weigh criminal charges against former Edwards aide Andrew Young, his wife and their two lawyers said Monday there’s not enough evidence to sustain a case. District Attorney Jim Woodall says he’s dropping the matter.

A judge previously found probable cause for contempt charges arising from a lawsuit filed against the Youngs by Rielle Hunter, who was Edwards’ mistress as he sought the White House in 2008. The state court ordered a lengthy deposition given by Edwards and other sensitive documents sealed.

Young and his lawyers say they gave those documents to federal prosecutors under a subpoena order.
