JACKSONVILLE, N.C. (CBS Charlotte) — “Spider-Man” finds himself on the other side of the law.

Dale Foughty, 56, of Jacksonville, allegedly attempted to rob a convenience store with a sword while wearing the superhero mask.

“At approximately midnight (on) Oct. 19, an older white male wearing a Spiderman mask and brandishing a sword walked into a local convenience store,” a release provided by the Onslow County Sheriff’s Office said. “When (Foughty), dressed as Spider-Man, stuck his sword in the clerk’s face and said, ‘Give me your money and I will not hurt you,’ the store clerk struck her broom hard into the belly of the suspect.”

In the struggle that followed, a second clerk, also armed with a broom, joined in the efforts to stop Foughty from robbing the store. When he was overpowered, they were able to rib off his mask, as well as part of his ponytail.

Foughty then fled the scene.

Law enforcement officers were alerted to the situation and quickly made their way to Foughty’s residence, where he was arrested on Oct. 20. He had taken drastic measures to avoid recognition, however.

“The suspect had shaved off his hair,” the release said. “His hair was all over the table in the living room, but the suspect was unable to get rid of the lumps on his head that were left by the broom handle.

“It was quite noticeable … that he was sore as a result of his encounter with the store clerk.”

Foughty is being held on a $10,000 bond, and faces charges of attempted armed robbery, assault with a deadly weapon inflicting serious injury, and injury to personal property.
