North Carolina Student Suspended for Facebook Comment Criticizing College

HICKORY, N.C. (CBS Charlotte) — Marketing student Marc Bechtol learned from Catawba Valley Community College that what you say can come back to haunt you.

The school suspended Bechtol on Oct. 4 for two semesters and banned him from campus in response to a comment he made about the school on Facebook.

The incident started when Bechtol was forced to sign up with the college’s debit card service through Higher One bank in order to access his grant money. In the process of signing up, he was reportedly asked for personal information, such as his Social Security number and his date of birth.

Not long after he signed up, he allegedly began to receive unwelcome spam email from various credit card companies.

According to the website for the Foundation for Individual Rights in Education, Bechtol wrote a post on the college’s Facebook page on Sept. 28 about the incident.

“Did anyone else get a bunch of credit card spam in their CVCC inbox today? So, did CVCC sell our names to banks, or did Higher One? I think we should register CVCC’s address with every porn site known to man. Anyone know any good viruses to send them?” it read.

“OK (sic), maybe that would be a slight overreaction,” Bechtol wrote under his own post moments later.

In response, the college sent a letter to Bechtol stating that, in light of his comments, he will receive a two-semester suspension and was prohibited from being on the school’s campus.

“The content of the post is disturbing and indicates possible malicious action against the college,” the letter, found on FIRE’s website, states.

Robert Shibley, senior vice president of FIRE, tells CBS Charlotte that the school’s reaction is both extreme, given the satirical nature of Bechtol’s initial post, and impractical, as he was reportedly suspended and banned from campus without warning.

“The school has some explaining to do as to why (they) are so sensitive to what was honestly not a particularly harsh criticism,” he added. “He is owed at least notice and a hearing before taking actions like this that could be adverse to frankly his life and career. It’s indefensible.”

The school has allegedly told Bechtol that he could return to the school, though according to Shibley, he was not formally notified in writing.

“We know he was told, I believe, yesterday that he could come back to class, (but) he hasn’t been told that he wasn’t suspended or his punishment was revoked,” he said. “(Bechtol) is planning to go back, but … the last thing I knew he hasn’t received anything in writing.”

 The college’s community relations office tells CBS Charlotte that “CVCC is involved in Mr. Bechtol’s due process and cannot comment at this time.”

    As an editor of student newspaper I once wrote an OpEd about Student Services at Edinboro University of PA, a state school, questioning why student government had out of state bank accounts. I was harassed by student government, called into hearings and eventually withdrew, never to graduate. The Treasurer of the University, however, was later indicted and served time for embezzlement. Edinboro, to this day, has not apologized despite the fact that I have friends in the Admin there who were in school with me at the time and know what happened.

    How ironic – at a place (or places) which supposedly allows for free speech, such as “hang Bush!” amongst other remarks made under “Academic Freedom” it seems only that it applies to the Upper Acadamia and not to anyone else – especially if it disagrees with them.     As a parent of three college students, I am so angry about the action taken against this student. Most colleges in this country have sold their students out to financial institutions for the sake of money. We have found the lending institutions to be just about as corrupt as they possible could become when he comes to student loans.This college was out of line and this young man was right to say what he did.

    Our colleges and universities have become instruments of oppression. College administrations have increasingly become authoritarian. It is not simply a matter of political correctness.

    What were once freewheeling incubators of diverse thought have become totally intolerant of any dissent. It is ironic that the biggest promoters of tolerance are in fact the most intolerant themselves. This has had a chilling effect on not just the students, but faculty and staff as well.

    It is more about small minded people than it is any orthodoxy. It is even more likely in smaller environments like community colleges and smaller departments of universities. These are people with no character and Napoleon complexes.

    The fact that accounts are getting spam is that the college administration and people with accounts in the university are going to sites that they are not supposed to. This is a state school, with state funding. I suspect college employees are going to porn sites or to gambling sites. They are caught so they expel the kid to cover up their illegal acts. The State AG needs to investigate, and you can find who did what in about five minutes.

    BTW- this is a scam on the part of the school. I am wondering what investments they are making with the assets deposited in the accounts? This requires an FBI investigation regarding fraud on the part of the school.

    Wrong. The First Amendment makes ALL SPEECH FREE.

    The federal government is prohibited from passing any law against libel, slander, or incitement to a crime.

    However, a State may deal with these things. You need to take a closer look at the Constitution. The Bill of Rights is not meant to protect us from ourselves… it’s meant to protect us from the federal government.

    Yes it is a free speech issue. He spoke his mind and nobody is stopping him. He can go out there and say as much as he wants. Nobody is stopping him. His free speech isn’t being violated people. He just doesn’t like the consequences of his free speech. Freedom of speech is not the same as freedom from consequences. Regardless if his post was satirical, because it is SO EASY to hear the inflection in a text or know the mind of the poster, it WAS an overt threat. Maybe instead of screaming that his rights were violated and enabling this type of behavior, the little punk got what he deserved.

    The f*cking idiots at my Christian high school have suspended me on two separate occasions. Once for an “anti-christian” Facebook post on pages not directly affiliated with the school [I did not use my personal account for this]. Second for something totally vague- they have described it along the lines of “verbal abuse”, yet I merely was verbally defending myself in response to another student’s explicit remarks. Wow, and to think of all my time and effort I wasted in those after-school activities, and they suspend me indefinitely. I am a fairly average to above average performing student, and there have been no genuine incidents where I have expressed myself violently.
